Terms and Conditions of Service
These Terms and Conditions govern your access to and use of the website, custom manufacturing portals, engineering design services, technical testing, machinery maintenance, training academy, and component distribution operated by Dawnell Industries ("Dawnell", "we", "us", or "our").
By accessing our website, uploading 3D CAD files, approving quotations, placing purchase orders, or registering for training courses, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree, please do not use our services.
1. Definitions & Corporate Entity
- "Dawnell Industries": Refers to the corporate entity, its subsidiaries, branch divisions, affiliates, directors, officers, and technical personnel.
- "Customer" / "Client" / "User": Any individual, business organization, enterprise, or educational institution accessing our website or commissioning services.
- "Services": Additive manufacturing (3D printing), CAD engineering design, finite element analysis (FEA), validation and metrology testing, printer servicing, AMC contracts, industrial training, and materials supply.
- "Client Assets": CAD geometries, 3D mesh files (.STL, .STEP, .OBJ, .3MF, etc.), mechanical drawings, technical specifications, or physical equipment provided by the Client.
- "Deliverables": Physical 3D printed components, design models, validation test reports, or service documentation delivered to the Client.
2. Eligibility & Authority
You represent and warrant that you are at least 18 years of age and possess full legal capacity to enter into binding commercial contracts under the Indian Contract Act, 1872. If you are accepting these terms on behalf of a corporate entity, educational institution, or partnership, you warrant that you hold express authority to legally bind that entity.
3. Business Division Terms & Conditions
- Quotations: Quotations generated via the portal or official email are estimates based on supplied geometric volumes, chosen materials (e.g., PLA, ABS, PETG, TPU, Nylon, Resin), infill density, and post-processing requirements. Quotes remain valid for fifteen (15) calendar days unless otherwise stated.
- Manufacturing Feasibility & Modifications: Dawnell reserves the right to review CAD geometry for build feasibility. If slicing or orientation reveals unprintable walls, unsupported overhangs, or high failure risks, we may suggest minor geometric modifications or alternate print orientations.
- Tolerances & Surface Finish: Additive manufacturing inherently exhibits layer lines, minor surface striations, and thermal shrinkage. Unless a precision CNC or metrology standard is explicitly contracted in writing, standard manufacturing tolerances are ±0.2 mm or ±0.5% (whichever is greater).
- Prototype Disclaimers: Unless expressly certified by Dawnell under formal aerospace, medical, or defense standards, all 3D printed parts are supplied as physical prototypes and functional test models. The Client is solely responsible for determining whether parts withstand end-use operating stresses.
3.2. Strict Prohibited Items Policy
Dawnell Industries strictly complies with the statutory laws of the Republic of India. You shall NEVER upload, transmit, or request the 3D printing, CAD design, or manufacturing of:
- • Weapons & Firearm Components: Receivers, frames, triggers, magazines, silencers, barrels, or any 3D printable firearm assembly and ammunition accessories.
- • Explosives & Tactical Combat Gear: Switchblades, brass knuckles, explosive precursor housings, or offensive tactical assault implements.
- • Illicit & Surveillance Devices: Lock-picking tools, concealed surveillance enclosures, or illicit substance paraphernalia.
- • Obscene or Defamatory Material: Sexually explicit, obscene, or defamatory 3D geometries prohibited under Section 67 of the Information Technology Act, 2000.
- • Infringing Intellectual Property: 3D files that knowingly violate third-party registered patents, industrial designs, or copyrights.
- Scope of Work (SOW): Engineering design, FEA, and simulation services are executed pursuant to a mutually agreed Scope of Work document or written project specification.
- Design Iterations: Unless expressly specified in the quotation, design fees include up to two (2) rounds of minor dimensional or aesthetic revisions. Structural overhauls or scope expansions will be invoiced as separate engineering change orders.
- Client Sign-off: The Client retains ultimate responsibility for approving final drawings prior to tooling, injection mold fabrication, or mass production.
- AMC Coverage: Annual Maintenance Contracts cover scheduled preventive maintenance and technical diagnosis as detailed in the contract schedule. Consumable items (nozzles, PTFE tubes, build sheets, belts, thermistors) and damage caused by power surges or unapproved third-party modifications are excluded unless otherwise stipulated.
- Site Readiness: For on-site repairs, Clients must furnish an environment meeting OEM electrical and ventilation guidelines (regulated power supply, UPS, dry ambient temperature).
- Course Fees & Registration: Enrollment is confirmed upon full receipt of scheduled program fees. All fees are subject to applicable GST.
- Cancellations & Rescheduling: Course cancellations requested at least seven (7) business days prior to batch commencement are eligible for a 75% refund. No refunds are granted for cancellations requested within seven days or for unattended sessions.
- Curriculum IP: Course slides, training exercises, CAD models, and lab manuals are the exclusive intellectual property of Dawnell Industries. Video or audio recording of sessions, unauthorized redistribution, and online publication are strictly prohibited.
- Lab Safety: Attendees in physical training labs must follow mandatory safety protocols, including eye protection and respirator usage around resin, laser sintering, and heated build chambers.
- Product Specifications: Technical filaments and spares are described with standard manufacturer specifications (e.g., diameter 1.75mm ±0.03mm, spool net weight, vacuum sealed with desiccant).
- Inspection & Replacement: Defective spools (e.g., compromised vacuum seal, tangled winding on unsealed spool, verified diameter variation beyond tolerance) must be reported within forty-eight (48) hours of receipt with unboxing photographs for verification and replacement.
4. Intellectual Property Rights & Indemnification
Client Ownership of Submitted Designs: The Client retains full ownership of all CAD files, 3D meshes, and technical specifications submitted to Dawnell. Dawnell claims no proprietary interest in Client designs, except for the limited license necessary to evaluate, slice, manufacture, and deliver the ordered parts.
Dawnell IP: All website text, code, visual designs, brand assets, proprietary slicer profiles, firmware patches, calibration routines, and academy materials are the sole property of Dawnell Industries protected under the Copyright Act, 1957 and Trade Marks Act, 1999.
Client Warranty & Indemnification
The Client explicitly warrants that any file, design, trademark, or blueprint supplied to Dawnell does not infringe upon the patent, copyright, industrial design, or trademark rights of any third party. The Client agrees to indemnify, defend, and hold harmless Dawnell Industries, its directors, employees, and agents from any claims, suits, liabilities, legal costs, or damages arising out of alleged intellectual property infringement or violation of Indian laws linked to the Client's submitted files.
5. Pricing, Taxes & Payment Terms
- Currency & Taxes: All pricing quoted on the website or formal estimates is denominated in Indian Rupees (INR) unless expressly stated otherwise. All supplies are subject to applicable Goods and Services Tax (GST).
- Advance Payments: Due to the custom, irreversible nature of additive manufacturing and custom material procurement, manufacturing commences only upon receipt of 100% advance payment (or agreed milestone payment schedules for enterprise corporate accounts).
- Invoicing: Formal tax invoices containing GSTIN details will be dispatched electronically to the billing email address provided during order confirmation.
6. Shipping, Transit & Inspection
- Logistics Partners: Deliveries across India are executed via trusted third-party courier and logistics partners. Quoted delivery timelines are good-faith estimates and may vary due to transit delays or weather events.
- Transit Inspection: The Client must inspect physical packages upon arrival. Any structural transit damage or component shortages must be noted on the delivery receipt and communicated in writing to support@dawnellindustries.com within forty-eight (48) hours of receipt, accompanied by clear digital photographs of the damaged packaging and parts.
7. Limitation of Liability & Warranty Disclaimer
To the maximum extent permitted under applicable Indian law, Dawnell Industries provides all services, prototypes, and website capabilities on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied, including warranties of merchantability or fitness for a particular purpose.
Aggregate Financial Liability Cap
In no event shall Dawnell Industries, its founders, or affiliates be liable for indirect, punitive, special, incidental, or consequential damages (including loss of profits, downtime, business interruption, or catastrophic equipment failure). In all circumstances, Dawnell's total cumulative liability arising out of or related to any order, service, or contract shall not exceed the actual net amount paid by the Client to Dawnell Industries for the specific order giving rise to the dispute.
8. Force Majeure
Dawnell Industries shall not be liable or held in breach of contract for any delay, manufacturing failure, or delivery disruption resulting from events beyond our reasonable control, including power grid blackouts, telecommunications disruptions, equipment breakdown, raw material shortages, acts of God, extreme weather, epidemics, strikes, transit embargoes, or government sanctions.
9. Governing Law & Dispute Resolution
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the Republic of India, without regard to conflict of law principles.
- Amicable Resolution: In the event of any controversy, claim, or dispute, the parties shall first attempt in good faith to resolve the issue through informal discussions for a period of thirty (30) business days.
- Arbitration: Any dispute that cannot be resolved amicably shall be referred to and finally resolved by sole arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be in India (State of Tamil Nadu / Karnataka). The proceedings shall be conducted in the English language.
- Exclusive Court Jurisdiction: Subject to arbitration, the competent civil courts located in India shall have exclusive jurisdiction over any legal proceedings arising hereunder.
